1. Enrolment and Registration:
- All students must complete the enrolment process, providing accurate and up-to-date information.
- Enrolment is not confirmed until all required forms and payments have been submitted and processed.
2. Tuition and Fees:
- Tuition fees are due on or before the specified date each term.
- Late payments may incur additional charges, as outlined on the website or communicated to you in advance.
- Fees are non-refundable unless otherwise specified, such as in cases of lesson cancellations by the School or as outlined in the Make-up Lessons policy.
3. Payment Terms and Conditions:
- Tuition fees must be paid on or before the due date for each term.
- Payments are processed according to the accepted methods specified on the website (e.g., credit card, bank transfer).
- A late payment fee may apply if payment is not received by the due date.
- Fees are non-refundable, except in specified circumstances (e.g., lesson cancellations or prorated deductions for pre-paid lessons as outlined under Termination of Lessons).
- The Student is responsible for ensuring payment is made promptly. Any issues or concerns with payments must be communicated to the School immediately.
4. Automatic Enrolment, Cancellation, and Lesson Change Policy:

Automatic Enrolment:
- When you sign up for a term, you are automatically enrolled for the following term unless you provide written notice of cancellation.
- This automatic enrolment will continue each term, and your lessons will be scheduled accordingly, unless we receive written notice from you requesting to cancel.

Cancellation and Notice Period:
- If you wish to cancel lessons for the following term, you must notify us in writing at least 4 weeks before the end of the current term.
- The best time to inform us of your intention to cancel is 4 weeks before the end of the current term, to allow for timely processing of your cancellation and to prevent automatic enrolment in the next term.
- Written cancellations should be sent to Contact@modernmusiclearning.co.nz or through other designated communication channels outlined on our website.

Change of Lesson Times or Days:
- If you wish to change the time or day of your scheduled lessons, you must provide written notice at least 4 weeks in advance.
- All changes to lesson times or days are subject to availability, and the School will make reasonable efforts to accommodate such requests.
- Requests for changes made within 4 weeks of the scheduled lesson may not be possible, and the student may be expected to continue with the original schedule until the following term.

Failure to Provide Notice:
- Failure to provide the required notice for cancellations or changes will result in you being automatically enrolled for the next term and charged accordingly.
- If notice is not given within the required timeframes, you may not be eligible for a refund or rescheduling of lessons.
5. Make-up Lessons:
- Each student is entitled to one make-up lesson per term, provided they meet the eligibility criteria outlined below.
- A make-up lesson may be offered if the student provides at least 24 hours' notice for a lesson cancellation. The make-up lesson must be scheduled within 2 weeks of the missed lesson and is subject to availability.
- Changing a lesson time or day for any reason will be considered the one make-up lesson for that term. Once the lesson time or day is changed, no further make-up lessons will be offered for that term.
- Any lesson cancellations or absences beyond the one make-up lesson will not be refunded or rescheduled.
- The make-up lesson must be scheduled with the instructor within 2 weeks of the missed lesson. Failure to schedule or attend the make-up lesson within this time frame will result in the forfeiture of that lesson.
6. Lesson Cancellations:
- A minimum of 24 hours' notice is required for lesson cancellations.
- Failure to provide timely notice may result in the forfeiture of the lesson without a refund.
7. Attendance:
- Regular attendance is essential for progress in your learning.
- Excessive absences may impact your ability to make adequate progress and may result in additional fees or suspension of lessons.
8. Communication:
- Effective communication is key to a positive learning experience. Please ensure that any changes in contact information are promptly communicated to the School.

9. Behavioural Expectations:
- Respectful behaviour towards instructors, staff, and fellow students is mandatory.
- Disruptive behaviour or failure to follow the School's guidelines may result in disciplinary action, including suspension or termination of lessons.
10. Lesson Materials:
- The Student is responsible for obtaining any required lesson materials promptly, as per the course guidelines.
11. Termination of Lessons:
- Either the Student or the School may terminate lessons with written notice.
- Refunds for pre-paid lessons may be subject to prorated deductions based on lessons already provided.
- If lessons are terminated by the School due to student behaviour, non-payment, or other factors, no refunds will be issued.
12. Privacy Policy:
- The School respects the privacy of all students. Personal information will not be disclosed without consent, except as required by law.
13. Photo and Video Release:
- By enrolling, students and parents/guardians grant permission for the School to use photos and/or videos for promotional purposes, unless otherwise specified.
14. Force Majeure:
- The School is not liable for failure or delay in performance due to events beyond its reasonable control, such as natural disasters, strikes, or other unforeseen circumstances.
15. Changes to Terms and Conditions:
- These terms and conditions are subject to change at the discretion of the School. Any significant changes will be communicated to students in advance.
16. Parental/Guardian Responsibilities (for Minor Students):
- If the student is under the age of 18, a parent or guardian must complete the enrolment and be responsible for all financial obligations.
- Parents/guardians are required to ensure that the student arrives on time for lessons and is prepared with the necessary materials and instruments.
- Parents/guardians should also ensure the student adheres to the School's behavioural expectations.
17. Instrument and Equipment Care:
- Students are responsible for the proper care and maintenance of any instruments or equipment they use during lessons.
- The School will not be responsible for any loss, damage, or theft of personal instruments or materials brought to the lesson.
- If the School provides instruments or equipment for lessons (e.g., keyboards, drum kits, sheet music), students are expected to use them responsibly. Any damage caused by neglect or misuse may result in repair or replacement fees.
18. Temporary Suspension of Lessons:
- The School reserves the right to suspend lessons for reasons beyond its control, including illness, public holidays, or other exceptional circumstances.
- In the case of a temporary suspension, students will be notified in advance, and the School will attempt to reschedule lessons where possible.
19. Holiday and Break Schedules:
- The School will notify students of any holiday or break schedules at the start of each term. During scheduled breaks, lessons may be paused or rescheduled based on the availability of both students and instructors.
- Specific dates for term breaks, public holidays, and other closures will be communicated at the start of each term and are available on the School’s website.
20. Online Lessons (if applicable):
- The School may offer online lessons in addition to in-person lessons. If a student is enrolled in online lessons, the following conditions apply:
- Students must have access to a stable internet connection, appropriate devices (e.g., computer, tablet, or smartphone), and any necessary software or applications for video conferencing.
- Students are responsible for ensuring their environment is quiet and free of distractions for online lessons.
- The School is not liable for disruptions to online lessons caused by issues outside of its control (e.g., internet outages, technical issues).
21. Special Needs and Accommodations:
- The School is committed to providing an inclusive learning environment for all students, including those with special needs.
- If a student requires any specific accommodations, adjustments, or support, the parent or guardian must inform the School in advance. The School will make reasonable efforts to accommodate such needs, depending on available resources.
22. Promotional Discounts and Offers:
- Any promotional offers or discounts are subject to the terms specified at the time of enrolment.
- Discounts cannot be applied retroactively to previously paid fees or outside of the promotional period.
- The School reserves the right to withdraw or amend promotional offers at any time without prior notice.
23. Liability and Waiver:
- By enrolling in lessons, the student (or parent/guardian) agrees to release and hold harmless Modern Music Learning, its instructors, staff, and affiliates from any liability for personal injury, property damage, or loss occurring during lessons or events hosted by the School.
