Modern Music Learning: Terms and Conditions

  1. Enrolment and Registration
    All students must complete the enrolment process, providing accurate and up-to-date information. Enrolment is not confirmed until all required forms and payments have been submitted and processed. To secure your enrolment, account holders must enter an up-to-date card on file. If this is not done, the enrolment cannot be secured, and the slot may be offered to another student.

  2. Tuition and Fees
    Tuition fees are due on or before the specified date each term. Payments are processed through our accepted methods, with credit card payments only available. Late payments may incur additional charges as outlined on the website or communicated to you in advance.
    Fees are non-refundable unless otherwise specified, such as in cases of lesson cancellations by the School or as outlined in the Missed Lesson policy. Tuition fees are billed via a monthly subscription and will continue until cancelled. A minimum of 4 weeks' notice is required before the next term begins to cancel the subscription. All students are enrolled for the full term and are required to complete the entire term.

  3. Payment Terms and Conditions
    Tuition fees must be paid on or before the due date for each term. Payments are processed through credit card only, as specified on the website. A late payment fee may apply if payment is not received by the due date.
    Fees are non-refundable, except in specified circumstances (e.g., lesson cancellations by the School or prorated deductions for prepaid lessons, as outlined under Termination of Lessons).
    The student is responsible for ensuring payment is made promptly. Any issues or concerns with payments should be directed to accounts@modernmusiclearning.co.nz.

  4. Automatic Enrolment, Cancellation, and Lesson Change Policy

  • Automatic Enrolment:
    When you sign up for a term, you are automatically enrolled for the following term unless you provide written notice of cancellation. This automatic enrolment will continue each term, and your lessons will be scheduled accordingly, unless we receive written notice from you requesting to cancel.

  • Cancellation and Notice Period
    If you wish to cancel lessons for the following term, please notify us in writing at least 4 weeks before the end of the current term. The ideal time to let us know is exactly 4 weeks before the term ends. This allows us enough time to process your cancellation and ensures you are not automatically enrolled for the next term.

    Why 4 weeks' notice? On average, it takes us 4 weeks to fill a lesson slot with a new student. When we don’t receive timely notice, it becomes difficult to reallocate the space, and unfortunately, this often results in your tutor losing paid work. We aim to provide consistency not just for our tutors, but also for students, as stable timetables create the best learning environment for everyone involved.

  • Change of Lesson Times or Days:
    If you wish to change the time or day of your scheduled lessons, you must provide written notice at least 4 weeks in advance. All changes to lesson times or days are subject to availability, and the School will make reasonable efforts to accommodate such requests. Requests for changes made within 4 weeks of the scheduled lesson may not be possible, and the student may be expected to continue with the original schedule until the following term.

  • Failure to Provide Notice:
    Failure to provide the required notice for cancellations or changes will result in you being automatically enrolled for the next term and charged accordingly. If notice is not given within the required timeframes, you may not be eligible for a refund or rescheduling of lessons.

  1. Missed Lesson Policy
    At Modern Music Learning, we do not offer make-up lessons. This helps us maintain a smoother system, protect tutor time, and avoid disruptions to learning.

  • Video Lesson in Place of Missed Lessons:
    If a student cancels a lesson with at least 7 hours' notice, the tutor will create a personalised video lesson during the original lesson time. This video will be sent directly to the student to ensure they stay on track. There is no limit to the number of video lessons a student can receive, as long as the correct notice is given.

  • How to Cancel:
    All cancellations must be made via the student portal. Please do not email cancellations, as these will not update the tutor or system automatically.

  • Late Notice or No-Shows:
    If less than 7 hours' notice is given or the student does not attend, no video lesson will be provided and the lesson is forfeited.

  • If a Tutor is Unavailable:
    In the event your tutor is away, we will:

    • Try to find a substitute tutor (the system will reflect this change).

    • Provide an online lesson during the scheduled time.

    • Create a bespoke video lesson.

    • If none of the above are possible, apply a credit for you to deduct from your next invoice.
      Please note: Applying this credit at the time of payment is your responsibility.

  1. Lesson Cancellations
    A minimum of 7 hours’ notice is required to cancel a lesson and be eligible for a bespoke video lesson from the tutor.
    If less than 7 hours’ notice is provided or the student does not attend the scheduled lesson, the session is forfeited with no refund or video lesson offered.
    All cancellations must be made via the student portal to ensure tutors, the school, and the schedule are automatically updated.
    Please do not email cancellations — these will not be processed or acknowledged.
    This policy ensures fairness for tutors and consistency for students, while still allowing for meaningful learning through video lessons when enough notice is given.

  2. Communication
    Effective communication is essential for a positive learning experience. Please ensure that any changes to your contact information are promptly updated with the School.

  3. Lesson Materials
    The student is responsible for obtaining any required lesson materials promptly, as per the course guidelines.
    We offer our own curriculum for students aged 6-12, as well as Rockschool, AMRSM, and bespoke lesson plans.
    If you need assistance purchasing any of the required materials, please contact your tutor directly or email admin@modernmusiclearning.co.nz.

  4. Liability
    Modern Music Learning is not liable for any loss, damage, or injury that occurs during lessons or while participating in any School-organised activities. Students and their parents/guardians accept full responsibility for their safety during lessons and activities.

  5. Conduct and Behaviour
    Students are expected to behave in a respectful and courteous manner during lessons and School-related activities. Failure to do so may result in the suspension or termination of lessons at the discretion of the School.

  6. Privacy Policy
    Modern Music Learning values your privacy. We will collect, store, and use your personal information only for the purposes of delivering lessons and communicating with you about School-related matters. Your information will not be shared with third parties without your consent, except as required by law.

  7. Amendments to Terms and Conditions
    Modern Music Learning reserves the right to amend these Terms and Conditions at any time. Students will be notified of any changes, and the revised terms will apply from the date of notification.

  8. Force Majeure
    The School will not be held responsible for any failure to perform or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, or other unforeseen events.

  9. Student Responsibilities
    Students are expected to arrive on time for their lessons. It is the student's responsibility to inform their tutor in advance if they are unable to attend a lesson or if they need to cancel.

  10. Tutor Responsibilities
    Tutors are responsible for preparing lessons, ensuring a safe and supportive learning environment, and communicating with students and parents about progress and any issues that arise.

  11. School Hours and Availability
    Lessons are available Monday through Saturday. The School will notify you of any planned closures due to holidays, maintenance, or other reasons. Any cancellations made by the School will be handled according to the Missed Lesson Policy.

  12. Refunds
    Tuition fees are non-refundable, except in certain circumstances as outlined under the Missed Lesson Policy, Lesson Cancellations, or as required by law.

  13. Suspension of Lessons
    The School reserves the right to suspend lessons if the student’s conduct is disruptive or if the student has an outstanding balance on their account. Suspension will be reviewed on a case-by-case basis.

  14. Gift Vouchers
    Gift vouchers can be purchased and used for lessons or merchandise. Gift vouchers are non-refundable and must be used within 12 months of the issue date.

  15. Classroom Conduct
    All students are expected to act in a manner that is respectful to others. Disruptive behaviour may result in a warning, followed by suspension from lessons if necessary.

  16. Student Progress and Feedback
    Students and parents are encouraged to provide feedback about the lessons and their progress. Regular progress reports will be made available for all students. If there are concerns, we encourage students and parents to discuss them with their tutor.

  17. Online Learning
    For students who are unable to attend in-person lessons, online lessons may be offered. These lessons will follow the same structure as in-person lessons, and the same policies will apply.

  18. Parent/Guardian Responsibilities
    Parents/guardians are responsible for supporting their child’s learning and ensuring that they complete any practice tasks assigned by the tutor. Communication between parents and the School is encouraged to ensure the best possible learning experience for the student.

  19. Termination of Lessons
    The School reserves the right to terminate lessons at any time if the student or parent fails to comply with the Terms and Conditions. In such cases, any outstanding fees will remain due.

Make-up Lesson Terms and Conditions -
Modern Music Learning

If a student is unable to attend a scheduled lesson, we require notification at least 24 hours in advance.

Notification can be provided through [specified communication channels, e.g., My Music Staff student portal]

Make-up lessons will be offered for the following
valid reasons:
• Personal illness or health issues.
• Family emergencies.
• School-related commitments.
• Teacher's absence (if applicable).

To request a make-up lesson, the student or parent/ guardian must notify the instructor within 24 hours of the
missed lesson and provide a valid reason for the absence.

Make-up lessons are subject to instructor availability and must be scheduled within [specified time frame, e.g., two weeks] of the missed lesson.

Students are entitled to a maximum of one make-up lessons per term.

In the case of group classes, makeup lessons will be facilitated whenever possible. If another group is
available for the student to join on a one-off basis, we will ensure that they have the opportunity to make up any
missed lessons.

Failure to provide 24 hours' notice or repeated no-shows will result in the forfeiture of the make-up lesson opportunity.

In the event of inclement weather affecting transportation, make-up lessons will be offered. The decision to cancel due to weather will be made by the instructor.

In the event of the instructor's absence, make-up lessons will be offered at a time convenient for both parties.

Make-up lessons are a courtesy extended to active, enrolled students. In the event of lesson termination, any unused make-up lessons will be forfeited.

These terms and conditions are subject to change. Students and parents will be notified of any changes in advance.
