Terms & Conditions


Welcome

Welcome to Modern Music Learning ("the School").

Our mission is to inspire a lifelong love of music by providing engaging, practical and performance-based music education for students of all ages.

These Terms & Conditions explain how our programmes operate and form part of your membership with Modern Music Learning.

By enrolling with Modern Music Learning, you acknowledge that you have read, understood and agree to these Terms & Conditions.

For students under the age of 18, these Terms & Conditions must be accepted by a parent or legal guardian on the student's behalf.


1. Enrolment

Modern Music Learning offers programmes for the following age groups:

  • Early Childhood Programme (2–4 years)
  • Mini Band Club (4–7 years)
  • Junior Programme (7–12 years)
  • Teen Programme (13–17 years)
  • Adult Programme (18+ years)

Enrolment is confirmed once:

  • the enrolment form has been completed;
  • these Terms & Conditions have been accepted;
  • a valid payment method has been provided;
  • the first membership payment has been successfully processed; and
  • a suitable lesson, class or programme place has been allocated.

Your enrolment reserves your place within the School.

Modern Music Learning reserves the right to decline, postpone or cancel an enrolment where a suitable tutor, lesson time, class or programme is unavailable or where enrolment is not considered suitable.


2. Agreement to these Terms

Acceptance of these Terms & Conditions is a condition of enrolment.

By submitting an enrolment form, providing payment details or continuing with an active membership, the account holder confirms that they have read, understood and agreed to the current Terms & Conditions.

For students under 18 years of age, the parent or legal guardian accepts these Terms & Conditions on behalf of the student.

Modern Music Learning may update these Terms & Conditions from time to time. Members will be advised of significant changes before they take effect.


3. Our Annual Music Programme

Modern Music Learning operates an annual music education programme.

Rather than purchasing individual lessons, students join an ongoing programme designed to provide consistent musical development throughout the year.

Depending on the student's programme, membership may include:

  • Weekly lessons
  • Holiday Programmes
  • Concert Weeks
  • Band Weeks
  • Workshops
  • Performance opportunities
  • Showcases
  • Other educational activities organised by the School

These activities form part of the student's annual learning experience and may replace regular weekly lessons where applicable.


4. Programme Pathways

Modern Music Learning delivers different programmes depending on the student's age and stage of learning.


Early Childhood Programme (Ages 2–4)

Our Early Childhood Programme introduces young children to music through movement, singing, rhythm, creativity and play.

The programme focuses on developing confidence, listening skills, coordination and a love of music in a fun and engaging environment.

Classes operate according to the published Annual Calendar.


Mini Band Club (Ages 4–7)

Mini Band Club has been specifically designed for young musicians beginning their musical journey.

Students attend their regular weekly class throughout the year.

Unlike older programmes, Mini Band Club generally continues during school holidays (excluding public holidays and the Christmas and New Year closure).

Mini Band Club does not participate in the Holiday Programme offered to students aged 7–12.


Junior Programme (Ages 7–12)

Students aged 7–12 participate in our annual Junior Programme.

During teaching weeks, students attend their regular weekly lesson.

During scheduled school holidays, weekly lessons are replaced by the Modern Music Learning Holiday Programme.

Membership includes access to up to two Holiday Programme days each week during every scheduled Holiday Programme.

Throughout the year students may also participate in:

  • Concert Weeks
  • Band Weeks
  • Workshop Weeks
  • Performances
  • Other curriculum activities

These activities form part of the annual curriculum and replace regular lessons where applicable.

Holiday Programme places must be booked in advance and are subject to availability.

If a student cannot attend a Holiday Programme day, the entitlement may be transferred to a sibling or friend of an appropriate age, subject to approval by the School and completion of any required enrolment information.

If a Holiday Programme entitlement is not used, no replacement lesson, refund or credit will be provided.


Teen Programme (Ages 13–17)

Teen students continue lessons throughout the year, including school holidays.

During holiday periods, tutors may adjust lesson days or lesson times to accommodate holiday schedules.

Students and families agree to remain reasonably flexible during these periods, and the School will make every reasonable effort to arrange a suitable alternative lesson time.

Teen students may also participate in bands, workshops, showcases and performance opportunities throughout the year.


Adult Programme (18+)

Adult students continue lessons throughout the year, including school holidays.

Tutors may adjust lesson days and lesson times during holiday periods where necessary.

The School will work with adult students to arrange mutually suitable lesson times wherever possible.

Adult students may also participate in workshops, performances and other educational opportunities offered by Modern Music Learning.


5. Annual Calendar

Modern Music Learning publishes an Annual Calendar each year.

The Annual Calendar outlines all scheduled programme activities including:

  • Teaching weeks
  • Holiday Programmes
  • Concert Weeks
  • Band Weeks
  • Workshop Weeks
  • Public holidays
  • Christmas and New Year closure
  • School events
  • Other educational activities

Parents and students agree to follow the published Annual Calendar.

Where programme activities replace regular weekly lessons, the Annual Calendar takes precedence over normal lesson schedules.

6. Membership & Payments

Modern Music Learning operates on an ongoing membership basis.

Membership reserves the student's place within their lesson, class or programme and provides access to the annual music programme appropriate to their age.

Membership fees are billed in advance.

Members may choose from the following payment options:

  • Monthly
  • Quarterly
  • Annually

Monthly memberships are billed automatically on the 1st of each month using the nominated payment method.

Quarterly and annual memberships are billed in advance at the beginning of each billing period.

Membership fees contribute towards the delivery of the annual programme and are not based solely on the number of lessons delivered within a particular month.

As the annual programme includes Holiday Programmes, Concert Weeks, Band Weeks, workshops and other educational activities, membership fees remain payable throughout the year, including December.


7. Payment Methods

A valid payment method must remain on file at all times.

Payments are processed automatically using the nominated payment method.

Members are responsible for ensuring their payment details remain current.

If a payment cannot be processed, Modern Music Learning will automatically attempt to process the payment again.

If payment remains outstanding for more than 10 days, a $15 late payment fee will be added to the account.

The School reserves the right to suspend lessons, classes or programme participation until the account has been brought up to date.


8. Intro Lesson

All new students begin with a one-off Intro Lesson.

The Intro Lesson allows the tutor to:

  • Meet the student.
  • Discuss musical goals.
  • Assess current ability and experience.
  • Recommend the most suitable learning pathway.
  • Introduce the Modern Music Learning teaching approach.

The Intro Lesson fee is $39.

The Intro Lesson is payable in advance.

Each student is eligible for one Intro Lesson only.

The Intro Lesson fee is non-refundable except where required by New Zealand law.


9. Membership Cancellation

Membership continues until cancelled.

Members paying monthly, quarterly or annually may cancel their membership at any time by emailing:

Cancellation requests are not accepted through the Student Portal or by advising a tutor.

Membership remains active until the end of the current paid billing period.

No refunds or prorated credits will be given for partially used billing periods, except where required by New Zealand law.

Once membership ends, the student's lesson time, class place or programme place may be offered to another student.


10. Membership Pauses

Private lesson memberships may be paused by providing at least four (4) weeks' written notice to:

Pause requests are subject to tutor availability and the School's ability to hold the student's lesson time.

A paused membership does not guarantee that the original lesson day, lesson time or tutor will be available when the student returns.

Group programme memberships cannot be paused.

This includes, but is not limited to:

  • Early Childhood Programme
  • Mini Band Club
  • Junior Band Club
  • Other group classes

Students taking short holidays should refer to the Missed Lessons Policy.


11. Changes to Membership

Students may request changes to their membership including:

  • Lesson day
  • Lesson time
  • Tutor
  • Instrument
  • Lesson length
  • Moving between private lessons and group programmes

All requests must be made by contacting the School office at:

Changes are subject to tutor availability, programme availability and suitable lesson times.

While the School will make every reasonable effort to accommodate requests, changes cannot be guaranteed.

Where membership fees change, billing will be adjusted from the approved effective date.


12. Re-enrolment

Former students are always welcome to return to Modern Music Learning.

Where possible, the School will offer the student's previous lesson time, tutor or class if it remains available.

If the previous place is no longer available, the student will be offered the next most suitable option or placed on a waiting list.

Re-enrolment is subject to programme availability.


13. Waiting Lists

If a lesson, class or programme is full, students may join a waiting list.

Private Lessons

Private lesson places are generally offered in the order students join the waiting list.

When a place becomes available, the family will have 48 hours to accept the offer before it may be offered to another student.

Group Programmes

For group programmes, Modern Music Learning reserves the right to offer places based on the most suitable combination of:

  • Age
  • Ability
  • Experience
  • Group dynamics

This helps provide the best learning experience for all students.

Placement on a waiting list does not guarantee a place, a particular tutor or a preferred lesson time.

The School reserves the right to manage waiting lists in the best interests of programme delivery and student learning.

14. Lesson Attendance

Students are expected to arrive on time and ready to participate in their scheduled lesson, class or programme.

Late arrival does not extend the scheduled finishing time.

Regular attendance is encouraged to help students achieve consistent musical progress.


15. Missed Lessons

Modern Music Learning does not provide make-up lessons.

If a student is unable to attend their scheduled lesson, at least 7 hours' notice must be provided through the Student Portal.

If sufficient notice is received:

  • The tutor will prepare a personalised video lesson during the student's scheduled lesson time.
  • The video lesson will support the student's continued learning until their next lesson.

Lesson cancellations must be submitted through the Student Portal.

Lesson cancellations made by email, phone, text message or directly to a tutor are not considered valid lesson cancellations.

If less than 7 hours' notice is provided, or the student does not attend their lesson:

  • The lesson is forfeited.
  • No make-up lesson will be provided.
  • No refund will be given.
  • No lesson credit will be issued.

In exceptional circumstances, such as hospitalisation or a serious medical event supported by a medical certificate, Modern Music Learning may consider an alternative arrangement at its sole discretion.


16. Tutor Absence

If a tutor is unavailable due to illness, leave or other unforeseen circumstances, Modern Music Learning will make every reasonable effort to continue the student's learning.

Where possible, the School will:

  1. Arrange a suitably qualified substitute tutor.
  2. Offer an online lesson.

If neither option is reasonably available, a lesson credit will be applied to the student's account.

Lesson credits:

  • cannot be exchanged for cash;
  • are not transferable; and
  • may only be used towards future membership fees.

17. Public Holidays & School Closures

Modern Music Learning does not operate on public holidays unless otherwise advised.

The School may also close for:

  • Teacher professional development
  • Staff training
  • Building maintenance
  • Other operational requirements

Where practical, reasonable notice will be provided.


18. Christmas & New Year Closure

Modern Music Learning closes over the Christmas and New Year period each year.

Closure dates are published in the Annual Calendar.

As Modern Music Learning operates an annual music education programme, membership fees continue throughout December.

Membership fees are calculated across the annual programme rather than the number of lessons delivered during any individual month.

Your membership reserves your place within the programme and contributes towards the delivery of the annual curriculum, including:

  • Weekly lessons
  • Holiday Programmes
  • Concert Weeks
  • Band Weeks
  • Workshops
  • Performances
  • Other educational activities

No refunds, credits or reductions are provided for the Christmas and New Year closure.


19. Student Commitment & Practice

Regular attendance and participation are important for successful musical development.

Students enrolled in:

  • Private lessons
  • Teen Programme
  • Adult Programme

are expected to practise between lessons and complete any activities set by their tutor.

Parents and caregivers are encouraged to support younger students with regular practice at home.

Mini Band Club and Junior Band Club programmes are designed around guided learning during class time.

While practising at home is encouraged where appropriate, it is not an expectation of these programmes.

Student progress depends on many factors including:

  • Attendance
  • Practice
  • Participation
  • Attitude
  • Individual commitment

Modern Music Learning cannot guarantee examination results, competition outcomes or a particular rate of progress.


20. Concerts, Band Weeks, Holiday Programmes & Curriculum Activities

Modern Music Learning believes performance is an important part of learning music.

Throughout the year, students may participate in:

  • Concert Weeks
  • Performances
  • Band Weeks
  • Holiday Programmes
  • Workshops
  • Other educational activities

These activities form part of the annual curriculum and may replace regular weekly lessons.

Concerts & Performances

Students are encouraged to participate in all scheduled performances.

If a student chooses not to perform, they are still expected to attend during their allocated session unless otherwise agreed by the School.

No replacement lesson, refund or lesson credit will be provided.

Band Week

Band Week forms part of the annual curriculum for applicable students.

Band Week replaces the student's regular weekly lesson where scheduled.

If a student chooses not to attend, no replacement lesson, refund or credit will be provided.

Holiday Programme (Students Aged 7–12)

During scheduled Holiday Programme weeks, regular weekly lessons are replaced by the Holiday Programme.

Membership includes access to up to two Holiday Programme days per week.

Holiday Programme places must be booked in advance.

If a student cannot attend, they may nominate a sibling or friend within the appropriate age range to attend in their place, subject to approval by the School and completion of any required enrolment information.

Unused Holiday Programme entitlements are forfeited and cannot be exchanged for replacement lessons, refunds or credits.

21. Communication

To ensure enquiries are managed efficiently, the following communication channels apply:

School Office

The School office should be contacted for all enquiries relating to:

  • Enrolments
  • Membership changes
  • Cancellations
  • Payments
  • Billing
  • General administration

Office enquiries can be made:

Student Portal

The Student Portal is used for:

  • Lesson cancellations
  • Viewing lesson information
  • Lesson resources and assignments

The Student Portal should not be used for billing enquiries, membership changes or general administration.

Tutors

Tutors are responsible for teaching and student learning.

Tutors are not responsible for:

  • Membership administration
  • Billing
  • Payments
  • Enrolments
  • Cancellation requests

Any enquiries relating to these matters should be directed to the School office.

Parents and students are responsible for ensuring their contact details remain up to date.


22. Photography & Video

From time to time, Modern Music Learning may take photographs or videos during:

  • Lessons
  • Holiday Programmes
  • Concerts
  • Performances
  • Workshops
  • Other School activities

These images and videos may be used for:

  • The School website
  • Social media
  • Newsletters
  • Promotional material
  • Marketing

If you do not wish for you or your child to appear in photographs or videos, please notify the School in writing by emailing:

The School will make every reasonable effort to ensure you or your child is not included in future promotional material.


23. Student Drop-off & Collection

Parents and caregivers are responsible for dropping students off at the entrance to Modern Music Learning and collecting them promptly from the same location at the conclusion of their lesson or programme.

For the safety of all students:

  • Children must not wander around the building.
  • Children must remain within Modern Music Learning unless supervised by a parent or caregiver.

Tutors supervise students only during their scheduled lesson or programme.

Parents and caregivers remain responsible for students before and after their scheduled lesson.

If you are running late collecting your child, please notify the School as soon as possible.


24. School Property & Personal Belongings

Students are expected to treat all School property with care and respect.

This includes:

  • Musical instruments
  • Amplifiers
  • Equipment
  • Furniture
  • Teaching resources
  • Facilities

Parents or caregivers may be held responsible for repairing or replacing School property that has been deliberately or negligently damaged.

Food and drink are not permitted in teaching rooms other than water in a sealed drink bottle, unless approved by the School.

Students are responsible for their own personal belongings.

Modern Music Learning accepts no responsibility for loss, theft or damage to personal property brought onto the premises.


25. Illness & Infectious Conditions

Students who are unwell or have an infectious illness should not attend lessons or School activities.

Where practical and appropriate, an online lesson may be offered at the School's discretion.

Otherwise, students should cancel through the Student Portal.

Where at least seven (7) hours' notice is provided, the Missed Lessons Policy will apply and the tutor will prepare a personalised video lesson.

Modern Music Learning reserves the right to refuse entry to any student who appears unwell or may pose a health risk to others.


26. Severe Weather & Emergency Closures

The safety of students, families and staff is our highest priority.

Where it is safe to do so, lessons and programme activities will continue as scheduled.

If Modern Music Learning is required to close due to:

  • Severe weather
  • Flooding
  • Earthquake
  • Fire
  • Power outage
  • Public health event
  • Other circumstances beyond the School's reasonable control

the School will make every reasonable effort to continue learning by:

  1. Providing an online lesson where practical; or
  2. Applying a lesson credit where an online lesson cannot reasonably be provided.

Families will be notified as soon as reasonably possible.


27. Student Behaviour

Modern Music Learning is committed to providing a safe, welcoming and respectful learning environment.

Students are expected to:

  • Treat tutors, staff and other students with respect.
  • Follow reasonable instructions from staff.
  • Respect School equipment and facilities.
  • Behave safely at all times.

Parents, caregivers and visitors are also expected to behave respectfully towards staff, tutors, students and other families.

Bullying, harassment, abusive language, threatening behaviour or violence will not be tolerated.

The School reserves the right to ask any person to leave the premises where their behaviour is considered inappropriate or unsafe.

28. School's Right to Suspend or Terminate Membership

Modern Music Learning is committed to providing a safe, respectful and positive learning environment for all students, families and staff.

The School reserves the right to suspend or terminate a student's membership immediately where, in the School's reasonable opinion, there has been:

  • Non-payment of membership fees.
  • Repeated breaches of these Terms & Conditions.
  • Repeated disruptive, unsafe or inappropriate behaviour.
  • Bullying, harassment, abusive, threatening or aggressive behaviour towards tutors, staff, students or other families.
  • Deliberate or reckless damage to School property or equipment.
  • Illegal activity while attending the School or participating in School activities.
  • Any conduct that places the safety, wellbeing or enjoyment of others at risk.

Where appropriate, the School will endeavour to discuss concerns with the student or parent before taking action. However, Modern Music Learning reserves the right to suspend or terminate membership immediately where it considers this necessary to protect students, families, staff or the operation of the School.

Termination of membership under this clause does not automatically entitle the member to a refund of fees already paid, except where required by New Zealand law.


29. Privacy

Modern Music Learning is committed to protecting your privacy.

We collect and store personal information for the purpose of:

  • Processing enrolments and memberships.
  • Delivering music lessons and programmes.
  • Communicating with students and families.
  • Managing billing and payments.
  • Meeting our legal obligations.

Personal information is managed in accordance with the Privacy Act 2020 and will not be shared with third parties except where required by law or where reasonably necessary to provide our services.

You may request access to or correction of your personal information by contacting the School.


30. Liability

While Modern Music Learning takes reasonable care to provide a safe and supportive learning environment, participation in lessons and School activities is at the student's own risk.

To the fullest extent permitted by New Zealand law, Modern Music Learning is not liable for any loss, damage, injury or expense arising from participation in lessons, programmes or School activities except where liability cannot legally be excluded.

Students and parents are responsible for following all reasonable instructions provided by tutors and staff to help maintain a safe learning environment.

Nothing in these Terms & Conditions limits or excludes any rights or remedies available under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Privacy Act 2020 or any other applicable New Zealand legislation.


31. Changes to Membership Fees

Modern Music Learning may review and update membership fees from time to time.

Members will receive at least 30 days' written notice before any change to membership fees takes effect.

Updated fees will apply from the next applicable billing period following the notice period.


32. Changes to these Terms & Conditions

Modern Music Learning may update these Terms & Conditions where reasonably necessary to reflect changes to:

  • Programmes
  • Memberships
  • School operations
  • Technology
  • Legal requirements
  • Business practices

Where changes are significant, members will receive reasonable notice before the updated Terms & Conditions take effect.

The most current version of these Terms & Conditions will always be available on the Modern Music Learning website.

Continued membership after updated Terms & Conditions take effect constitutes acceptance of those updated Terms & Conditions.


33. Acceptance of these Terms & Conditions

By enrolling with Modern Music Learning, providing payment details or continuing an active membership, you confirm that you:

  • Have read these Terms & Conditions.
  • Understand these Terms & Conditions.
  • Agree to be bound by these Terms & Conditions.
  • Agree to the applicable membership fees and payment arrangements.
  • Agree to participate in the annual programme applicable to your enrolment.

For students under the age of 18 years, these Terms & Conditions are accepted by a parent or legal guardian on behalf of the student.


By enrolling in Modern Music Learning you acknowledge and agree to abide by these terms and conditions.

Make-up Lesson Terms and Conditions -
Modern Music Learning

If a student is unable to attend a scheduled lesson, we require notification at least 24 hours in advance.

Notification can be provided through [specified communication channels, e.g., My Music Staff student portal]

Make-up lessons will be offered for the following
valid reasons:
• Personal illness or health issues.
• Family emergencies.
• School-related commitments.
• Teacher's absence (if applicable).

To request a make-up lesson, the student or parent/ guardian must notify the instructor within 24 hours of the
missed lesson and provide a valid reason for the absence.

Make-up lessons are subject to instructor availability and must be scheduled within [specified time frame, e.g., two weeks] of the missed lesson.

Students are entitled to a maximum of one make-up lessons per term.

In the case of group classes, makeup lessons will be facilitated whenever possible. If another group is
available for the student to join on a one-off basis, we will ensure that they have the opportunity to make up any
missed lessons.

Failure to provide 24 hours' notice or repeated no-shows will result in the forfeiture of the make-up lesson opportunity.

In the event of inclement weather affecting transportation, make-up lessons will be offered. The decision to cancel due to weather will be made by the instructor.

In the event of the instructor's absence, make-up lessons will be offered at a time convenient for both parties.

Make-up lessons are a courtesy extended to active, enrolled students. In the event of lesson termination, any unused make-up lessons will be forfeited.

These terms and conditions are subject to change. Students and parents will be notified of any changes in advance.
By enrolling in our lessons, you acknowledge and agree to abide by these make-up lesson terms and conditions.
